  1. ELIGIBILITY. You must be 18 years of age and a legal resident of the United States to be eligible to participate in the Frugality Game (the "Game").
  2. CONFIDENTIALITY. All personal information provided by a player while playing the Game will be treated as confidential and is subject to the Privacy Statement or outlined in the Terms and Conditions of Use. The financial information provided by Game participants cannot be viewed or accessed by other players of the Game.
  3. PRIZES.
    1. $50,000. At the Sponsor's discretion: After federal, state, and local withholdings, as applicable, the prize will first be applied toward paying off the winner’s eligible debt (if any) directly. "Eligible debt" is limited to balances due on credit cards and other unsecured consumer loans from established financial institutions. Winner must present verifiable statements showing actual amount of eligible debt and authorize Sponsor to verify the balances with creditors. Winner must authorize Sponsor to pay the winner’s creditors directly for eligible debt. The order the prize is applied to multiple creditors will be at the Sponsor’s sole discretion. After withholdings and application to eligible debt, the remaining prize amount, if any, will be awarded.
    2. A new Smart Car®. Minimum total value $14,000, but not to exceed $20,000. Exact value depends on Sponsor’s choice of model, based on availability at time of selection. Smart USA is not affiliated with the Game or Sponsor.

      All prizes are guaranteed to be awarded for qualified winners. There is a limit of one prize per registered participant. Prizes are not transferrable or redeemable for cash and there are no substitutions. All taxes on prizes are the responsibility of winners and winners will be issued a 1099 for the value of the prize. Sponsor may announce additional prizes, with applicable rules.
  4. HOW TO PLAY. No purchase necessary.

    You must register for and play the Game to qualify. To be eligible to win, a player must (i) register for the Game by June 30, 2010, (ii) complete the required challenges and activities by November 30, 2010, and (iii) engage in quality participation, as judged in the sole and absolute discretion of the Game Sponsor (based on how well players complete the activities and challenges, including budgeting and journal entries). The odds of winning depend in part on total numbers of eligible Game participants who complete the required activities and challenges with quality participation.

    All players that properly complete the required activities and challenges and have received a designated number of tokens (awarded for completion of Game activities and challenges) will be placed in a winners round. For this purpose, the designated number of tokens will be determined by the top twenty-five percent of tokens earned at the end of the required challenges and activities.

    Winners will be selected by random drawing from qualified participants from the winners round. Random drawings will be held by December 15, 2010 under the supervision of the Game Sponsor. All decisions by the Game Sponsor are final and binding. Winners will be notified by either e-mail or mail. Failure to claim a prize within 14 days of notification will result in prizes being given to alternate winners. All winners are subject to verification of eligibility and compliance with Game rules.
  5. DISPUTES/CHOICE OF LAW. Players agree that the game sponsor has the sole right to decide all matters and disputes arising from the Game and that all decisions are final and binding. However, except where prohibited, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Game or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in Orange County, California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; and (3) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, "Special Damages"), and (4) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. California law, without reference to California's choice of law rules, governs the Game and all aspects related thereto.
  6. INCIDENTS. If for any reason the Game is not capable of being completed as planned, including infection by computer virus, tampering, unauthorized intervention, fraud, technical issues or any other causes that impair the completion or corrupt the Game, the Game Sponsor reserves the right in its sole discretion to modify, cancel or terminate the Game. The Game Sponsor also reserves the right to disqualify any individual who violates Game rules, attempts to interfere in the operation of the Game or the play of another player, or acts in a disruptive manner.
  7. PRIZE SPONSOR. The Prize Sponsor is The Frugality Game, Inc., 19500 Jamboree Rd., Suite 300, Irvine CA 92612.
  8. LAW. All federal, state and local laws apply. The Game is void where prohibited by law.
  9. GAMBLING PROHIBITION: This Game is strictly for entertainment purposes and may not be used in connection with any form of gambling.
  10. RELEASE. By participating in this Game or receiving a prize, entrants (and in particular, winners) agree to release and to indemnify and hold harmless Sponsor, and each of their respective related companies, and all of its or their company's officers, directors, employees and agents (collectively, the "Released Parties") for any liability, injury, death, loss or damages to entrant or any person or entity, including without limitation damage to personal or real property, caused in whole or in part, directly or indirectly, by participation in this Game (or related activities) or the acceptance, possession or use/misuse of a prize (including any travel or activity related to the prize).
  11. LIMITATIONS OF LIABILITY. The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment, hardware, software or programming associated or used with the Game; (2) technical errors, defects, delays or failures of any kind, including without limitation malfunctions, interruptions or disconnections in communications lines, Internet or website access, hardware or software; (3) digital or electronic disruptions, e.g., viruses other security breaches; (4) unauthorized human intervention, e.g., hacking; (5) technical or human error which may occur in connection with any aspect of the Game; (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Game, access to, copying or downloading materials from The Frugality Game or any other website, or receipt or use of any prize.
  12. ACCEPT OFFICIAL RULES: Participation constitutes entrant's full and unconditional agreement to these official rules (the "Official Rules") and to Sponsor's (defined herein) decisions. The decisions of the Sponsor in regards to all matters of this Game are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
